Terms and conditions for service provision

1. Definitions
In these Terms of Business:
- "We", "us", "our" means Paul Fisher trading as EDJ Services
- "Client", "you", "your" means the person or entity engaging our services
- "Services" means the services we provide including EPCs, Legionella Risk Assessments, PAT Testing, and Floor Plans
- "Property" means the property or premises where services are to be performed
2. Application of Terms
These Terms of Business apply to all services provided by us. By engaging our services, you agree to be bound by these terms.
3. Service Provision
3.1 Scope of Services
We will provide the services as described in your booking or quotation. Services are provided by qualified and accredited assessors in accordance with relevant standards and regulations.
3.2 Access Requirements
You must provide:
- Access to all areas of the property as required
- Safe working conditions
- Notice of any hazards or special requirements
- Keys or access codes where necessary
- Cooperation and reasonable assistance
3.3 Cancellations and Rescheduling
Cancellations or changes must be notified at least 24 hours in advance. Late cancellations may incur a fee equal to 50% of the service charge. Failed access (no one present when arranged) will be charged in full.
4. Pricing and Payment
4.1 Pricing
- Prices are quoted per property/service
- Prices include VAT where applicable
- Prices are subject to change without notice
- Additional charges may apply for difficult access, large properties, or urgent appointments
4.2 Payment Terms - Standard Customers
- Payment is due within 7 days of invoice date
- Invoices are sent immediately after service completion
- Certificates are released upon payment confirmation
- Accepted payment methods: Card, BACS, QuickFile
4.3 Payment Terms - Trade Accounts
- Monthly consolidated invoicing
- Payment due within 14 days of invoice date
- Statements issued on 1st of each month
- Credit limits may apply
- We reserve the right to suspend services for overdue accounts
4.4 Late Payment
Late payments may incur:
- Reminder fees
- Interest charges as per the Late Payment of Commercial Debts (Interest) Act 1998
- Recovery costs
- Suspension of further services
5. Certificates and Reports
5.1 Delivery
Certificates and reports are typically delivered within 24-48 hours of assessment, subject to payment confirmation.
5.2 Registration
EPCs are registered with government-approved schemes as required by law. Property information becomes publicly accessible via the EPC register.
5.3 Accuracy
Certificates are based on information available at the time of assessment. We rely on information provided by you and visible evidence.
5.4 Amendments
If you believe there is an error in a certificate, contact us within 7 days. We will review and, if necessary, arrange a re-visit at no extra cost.
6. Liability and Insurance
6.1 Professional Indemnity
We maintain professional indemnity insurance appropriate to our services.
6.2 Limitation of Liability
Our liability for any claim is limited to:
- The amount paid for the specific service giving rise to the claim
- The limits of our professional indemnity insurance
6.3 Exclusions
We are not liable for:
- Indirect, consequential, or special damages
- Loss of profits, revenue, or business opportunity
- Claims arising from incorrect information provided to us
- Claims made more than 6 months after service completion
- Matters beyond our reasonable control
6.4 Property Damage
While we take care to avoid damage, we maintain public liability insurance. Any damage caused by our negligence will be addressed promptly.
7. Data Protection
We process personal data in accordance with UK GDPR and our Privacy Policy. By engaging our services, you consent to necessary data processing.
8. Intellectual Property
All certificates, reports, and materials we produce remain our intellectual property. You have a license to use them for their intended purpose but may not modify or reproduce them without permission.
9. Force Majeure
We are not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, or government restrictions.
10. Complaints Procedure
If you have a complaint:
- Contact us within 7 days of the service
- Provide details of your concern
- We will investigate and respond within 14 days
- If unresolved, you may escalate to our accreditation scheme
11. Warranties and Representations
You warrant that:
- You have authority to engage our services for the property
- Information provided to us is accurate and complete
- The property is safe for our assessors to enter
- You will notify us of any special circumstances
12. Third-Party Rights
These terms are between you and us. No third party has rights to enforce any term of this agreement.
13. Assignment
You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights or obligations to another party.
14. Entire Agreement
These Terms of Business, together with any quotation or booking confirmation, constitute the entire agreement between us regarding service provision.
15. Variations
We may update these terms from time to time. Updated terms will be posted on our website with an effective date. Continued use of our services constitutes acceptance of updated terms.
16. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.

18. Governing Law and Jurisdiction
These Terms of Business are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
